OVERVIEW OF RESIDENTIAL COVENANTS

Land Use and Building Type. No lot shall be used except for residential purpose exclusively. No building shall be erected, altered, placed or permitted to remain on any lot other than one detached single family dwelling, which dwelling shall not exceed two stories in height from the street level. No vinyl siding; 150 square feet of exterior brick minimum; mailbox by approval of developer; and roof must have a minimum 6/12 pitch. Homeowners on lake will pay a Homeowners Association Fee for maintenance of the lake.

Minimum Square Footage Standards and Specifications. The minimum standards and specifications for any dwelling exclusive of garage, porches, etc. shall be as follows:

Split Foyer - Min. 1,180 Main Level Living Space* *square footage minimums for homes NOT
Multi Level - Min. 1,280 Main Level Living Space* ON the lake will be 100 sq. ft. less
Ranch - Min. 1,360 Main Level Living Space*
Two Story - Min. 1,000 Main Level Living Space*

Garages & Driveways. All garages will be attached and shall provide sufficient space for at least three automobiles and the driveway approaches thereto shall be of concrete.

Storage Buildings. Storage buildings may be permanently constructed but must conform to exterior appearance and design to the principal structure of the home with same color siding and shingles. All storage buildings shall be placed on a solid permanent foundation within the minimum building setback line and must not exceed 150 square feet. No other outbuildings permitted.

Fences. No fence shall be erected, placed or altered on any lot nearer to any street than the minimum building setback line as provided by the ordinances of the City of Tea. They may be wooden type fences – no green treat – and those facing the street shall have the finished side facing out; or chain link fences – no galvanized – and must be coated and colored (black or brown); all fences must be approved by the developer and maintained by the homeowner.

Sidewalks. All lot purchasers shall, at their own expense, construct and maintain a 4’ wide sidewalk for the benefit of the public. The sidewalk shall be constructed to specification provided by the Developer and shall be situated within the public right-of-way immediately adjacent to and running the full lineal length of the street side property lot line. Weather permitting, the sidewalk shall be completed prior to occupancy but in no case later than three months following occupancy.

Landscaping. Front of property must be sodded with in-ground sprinkler system (water may be pumped from the lake for sprinkler system). Property must be landscaped within three months of occupancy; otherwise, this will be done by the Developer at the purchaser’s expense. There shall be a minimum of three trees per property, no smaller than 3” in diameter at base. No box elder, cottonwood, elm or other trash trees. No playground equipment to be installed in front of property.

Set Backs. 7’ from property line. 35’ from front property line.

Approval of Plans. No building, fence, wall or other structure shall be commenced, erected or maintained until the plans and specifications showing the nature, kind, shape, height, materials, floor plans, location and approximate cost of such structure shall have been submitted to and approved in writing by the Developer, if so requested by Developer prior to start of construction. Building plans shall consist of a site plan showing the entire location of the property residence and all buildings and the driveway; plans to show finished elevations with all roof pitches; and exterior materials and colors.
